General Terms and Conditions of Sale

1. General information

These general terms and conditions of sale apply to all services offered by Stéphanie Vuong (L'Énergie Essentielle), Chaussée de Louvain 471, 1030 Schaerbeek (Brussels), Belgium — energie.essentielle@outlook.com.

These services are contracted and invoiced by the legal entity Productions Associées ASBL (Smart cooperative), Rue Coenraets 72, 1060 Brussels, Belgium, company number 0896.755.397, VAT number BE 0896.755.397, Smart activity number 41677.

They include a section for individuals (article 2), a section for businesses (article 3) and common provisions (article 4).

2. Terms for individuals (B2C)

2.1 Scope

This section applies to sessions booked by consumers, i.e. natural persons acting for private purposes: sessions at the practice, home sessions, gift vouchers and session cards.

2.2 Services and prices

The services and their prices are described on the Individuals page. Prices are stated in euros, VAT included. The applicable price is the one in force at the time of booking.

2.3 Booking

Bookings can be made online via the “Book a session” page, which redirects to the Cal.com platform, or by e-mail or WhatsApp. Bookings are confirmed by e-mail or text message. By booking, the client confirms that they have read and accepted these terms.

2.4 Payment

Payment is made at the time of booking or at the end of the session, in cash, via Payconiq or via Wero. Gift vouchers and session cards are payable at purchase, using the same payment methods.

2.5 Cancellation and late arrival

• Any session may be cancelled or rescheduled free of charge up to 24 hours before the appointment, via WhatsApp.
• In the event of a later cancellation or an unannounced absence, the full price of the session is due, except in duly justified cases of force majeure. For a session card, the session is deducted.
• If the client arrives late, the session ends at the scheduled time and the full price remains due.
• If Stéphanie Vuong has to cancel an appointment, a new time slot is offered; failing that, any amounts already paid are refunded in full.

2.6 Right of withdrawal (distance booking)

When a booking is made at a distance (online, by e-mail, via WhatsApp or by telephone), the consumer has 14 days from the conclusion of the contract to withdraw, without giving any reason, by sending a clear statement to energie.essentielle@outlook.com. Amounts paid are refunded within 14 days, using the same means of payment.

If the client expressly requests that the session take place before the end of this period, they acknowledge that they lose their right of withdrawal once the session has been fully performed. If they withdraw before the session, only the cancellation terms of article 2.5 apply.

2.7 Gift vouchers

• Gift vouchers are valid for 1 year from the date of purchase. This date and the expiry date are shown on the voucher.
• They may be used for the session stated or for any session of equivalent value; for a more expensive session, the difference must be paid.
• They are neither refundable nor exchangeable for cash, except in the cases provided for by law (in particular when the right of withdrawal is exercised within 14 days of a distance purchase).

2.8 Session cards

• Cards of 5 and 10 sessions are valid for 1 year from the date of purchase. They are not personal and may be used by another person, provided that the cardholder informs Stéphanie Vuong by e-mail beforehand.
• Sessions not used by the expiry date are neither refunded nor extended, except where Stéphanie Vuong was unable to provide them or for a medical reason supported by a certificate.

2.9 Home sessions

Home visits within the Brussels region are available for bookings of at least 3 hours, subject to a surcharge of €10 to €15 per session, specified at the time of booking. The client provides a quiet, heated space large enough to set up the equipment.

2.10 Contraindications

Before each session, the person receiving the treatment informs Stéphanie Vuong of any relevant information: pregnancy, recent surgery, fever, infection, injury, heart or circulatory problems, ongoing treatment, etc. If in doubt, prior medical advice is recommended. Stéphanie Vuong may refuse or adapt a session if she considers that a contraindication exists; in that case, the session is not charged.

2.11 Respect and professional conduct

Sessions take place in a strictly professional setting. Stéphanie Vuong reserves the right to end any session immediately in the event of inappropriate behaviour; the session then remains due.

3. Terms for businesses (B2B)

3.1 Scope

This section applies to services provided to businesses, organisations and professionals (“the Client”): chair or futon shiatsu sessions in the workplace, self-massage, do-in or muscle-awakening workshops, and one-off services (team building, events), as described on the Company page. These terms prevail over the Client's purchasing conditions, unless otherwise agreed in writing.

3.2 Quotes and orders

Each service is subject to a free quote, valid for three months. The order becomes binding upon written acceptance of the quote (signature or confirmation e-mail). Any subsequent change is subject to an amendment or a new quote.

3.3 Prices

• Prices are stated in euros excluding VAT; VAT at the applicable rate is added.
• Indicative price from €25 excl. VAT per employee for chair shiatsu sessions, decreasing according to the number of employees and the frequency; the final price is the one stated in the quote.
• Minimum service duration: 2 hours.
• Outside the Brussels-Capital Region, Walloon Brabant and Flemish Brabant, travel costs may be added; they are stated in the quote.

3.4 Preferential rate for employees

For any contract providing for at least 4 hours of service per week, the Client's employees benefit, for the duration of the contract, from a preferential rate on a one-hour massage session for individuals. The terms (amount, proof of eligibility) are specified in the quote. This benefit ends with the contract.

3.5 Service conditions

• The Client provides a suitable space: approximately 1.50 × 3.00 m for chair shiatsu (a closed room or a separate area, for example screened off by a partition) and a closed room of approximately 2.30 × 3.00 m for futon shiatsu.
• The Client organises the employees' schedule and sends the list of time slots no later than one hour before the service.
• Employee participation is voluntary. Each participant may stop their session at any time or replace it with a guided self-massage.
• Before their session, each employee informs Stéphanie Vuong of any possible contraindication (see the list in article 2.10). If Stéphanie Vuong refuses a session on these grounds, the time slot remains chargeable; the Client may assign it to another employee.
• Sessions take place in a strictly professional setting. Stéphanie Vuong reserves the right to end any session immediately in the event of inappropriate behaviour; the time slot then remains due.

3.6 Cancellation and rescheduling

• A confirmed service cannot be cancelled.
• The Client may, however, reschedule it free of charge, provided that Stéphanie Vuong is notified at least 7 working days before the scheduled date.
• Time slots not used by employees on the day remain due.
• If Stéphanie Vuong is unable to attend (illness, force majeure), the service is rescheduled to a mutually agreed date, at no cost to the Client.

3.7 Recurring contracts

Contracts for regular services (for example weekly) are concluded for the term and on the dates stated in the quote.

3.8 Invoicing and payment

• For one-off services, a deposit of 50% of the total amount is payable no later than 7 calendar days before the date of the service. The remaining 50% is payable no later than the last day of the service.
• For regular sessions over one month or one quarter, at a rate of one session per week, the invoice is payable in full no later than 14 calendar days before the first session of the period.
• All amounts are payable by bank transfer.
• Payment of the deposit or invoice within the stated deadlines is a condition for confirming the service. If payment is not received by the due date, the service provider reserves the right to suspend or reschedule the service.
• Any late payment automatically incurs, without prior notice, late-payment interest at the statutory rate provided for by the Belgian Act of 2 August 2002 on combating late payment in commercial transactions, as well as a fixed compensation of €40 for recovery costs, without prejudice to further justified compensation.

3.9 Confidentiality and data

Stéphanie Vuong undertakes to keep confidential any information concerning the Client and its employees that she may become aware of during the services. Personal information shared by an employee during their session remains strictly confidential and is never disclosed to the employer. Personal data is processed in accordance with the privacy policy.

3.10 Liability

Stéphanie Vuong's liability is limited to proven direct damage and, in any event, to the amount invoiced for the service concerned, except in the case of gross negligence or wilful misconduct. Stéphanie Vuong is covered by professional liability insurance (see article 4.2).

3.11 Jurisdiction

Relations between Stéphanie Vuong and the Client are governed by Belgian law. Failing an amicable settlement, any dispute falls under the exclusive jurisdiction of the courts of the judicial district of Brussels.

Stéphanie Vuong is covered by professional liability insurance taken out with Baloise.

4.3 Personal data

Data collected during bookings and sessions is processed in accordance with the privacy policy.

4.4 Complaints and disputes (individuals)

Any complaint may be sent to energie.essentielle@outlook.com; an amicable solution will be sought first. Failing that, the consumer may contact the Consumer Mediation Service free of charge (www.mediationconsommateur.be). These terms are governed by Belgian law; in the event of a dispute with a consumer, the competent courts are determined in accordance with the law.

4.5 Changes to these terms

These terms may be amended at any time. The applicable terms are those in force on the date of booking or acceptance of the quote.

4.6 Language

These terms are a translation of the original French version. In case of discrepancy or difference in interpretation, the French version prevails.
